Order Acceptance
Your receipt of an electronic or other form of order confirmation signifies our acceptance of your order. ModMyDSi.com reserves the right at any time after receipt of your order to accept or decline your order for any reason. We may require additional verifications or information before accepting any order.
Typographical Errors
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, ModMyDSi.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. ModMyDSi.com shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, ModMyDSi.com shall immediately issue a credit to your credit card account in the amount of the charge.
Return policy and limited warranty
Every product you buy from ModMyDSi.com is backed first by the product manufacturer's warranty, if applicable. ModMyDSi.com's 30 day limited warranty against defects, also applies. ModMyDSi.com's 30 day limited warranty is a defective exchange policy that provides for either repair or replacement of merchandise that has been confirmed as defective by either the manufacturer or ModMyDSi.com. Hardware confirmed as defective by the product's manufacturer or ModMyDSi.com will either be exchanged or repaired at our sole discretion within the first 30 days of ownership only. The ownership period begins on the day of product delivery. After 30 days the product manufacturer's warranty is the only warranty in effect, if applicable. Terms and conditions may vary by product or manufacturer. ModMyDSi.com will assist customers whenever possible in gaining satisfaction with product manufacturers. For assistance or to exchange a defective product please contact us and we will provide you the necessary information on getting your product exchanged. We reserve the right to refuse a return or charge a restocking fee for damaged or incomplete returns. No returns or exchanges will be accepted without the prior approval issued by ModMyDSi.com. Shipping Policy
We have three main policies regarding shipping. First, During the checkout process, each customer is given a chance to choose the shipping method, with the exception of free shipping. If one or more products in an order qualifies for free shipping, ModMyDSi.com will, at its discretion, choose a suitable carrier for delivery. Tracking may or may not be available on the item as a result of the carrier choice. Second, Should a package be refused or returned to us unopened, the customer shall be charged a restocking fee of 15% of the order amount and/or pay shipping cost to re-ship the order. Third, should a package arrive damaged or opened, the customer is responsible for noting on the delivery receipt the condition of the package. If insurance was purchased on the item, the customer must make a claim with the carrier used to ship the item within 24 hours or the claim may be denied. We will make every effort to make sure all damaged articles are replaced in an expedited manner. As noted on our Shipping and Returns page, we are not responsible for lost or damaged mail unless insurance is purchased. Regardless of insurance being purchased, we are not responsible for late arrivals of your order.
Limitation of Liability
The customer agrees that ModMyDSi.com is not responsible for any damages related to the purchase of products, software, or services from ModMyDSi.com that may occur, and the customer assumes the entire cost of any damage resulting from the use of products and/or interaction (or failure to interact properly) with any products, software, or services provided by the ModMyDSi.com. To the maximum extent permitted by applicable law, in no event will ModMyDSi.com be liable for any damages whatsoever (including, but not limited to, damages or loss of business profits, business interruption, loss of business information, loss of goodwill, work stoppage, hardware or software disruption, impairment or failure, repair costs, time value, or other pecuniary loss) arising out of the use or inability to use the products purchased from ModMyDSi.com, or the incompatibility of software with any hardware, software or usage, even if you have been advised of the possibility of such damages from a third party. ModMyDSi.com shall not be responsible for losses that may occur from exchange rates, or from currency conversions, that take place, and the customer accepts the extra cost in exchanging currency or currency conversion offered by ModMyDSi.com and its partners at the time of purchase. ModMyDSi.com does not accept liability for personal system/hardware damages and/or lost or corrupted data (firmware/software) that may occur do to improper use of a product or from the use of malicious programs or viruses obtained by the customer. ModMyDSi.com does not accept liability for how the end user uses the products purchased at ModMyDSi.com.
